(hereinafter referred to as “Saikan System Co.) (hereinafter referred to as the “Company”) provides on this website (hereinafter referred to as the “Service”).     1. MCC reserves the right to suspend or discontinue all or part of the Service without prior notice to the user for any of the following reasons.
      1. When performing maintenance inspections or updating of computer systems related to this service
      2. In the event that provision of this service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disasters.
      3. In the event of computer or communication line outage due to accident
      4. In any other cases where the Company deems it difficult to provide this service.
    2. We shall not be liable for any disadvantage or damage incurred by the user or any third party due to the suspension or interruption of the provision of the Service.
  4. Article 4 (Restriction of Use)
    1. We reserve the right, without prior notice, to restrict a user’s use of all or part of the Service if the user falls under any of the following.
      1. Violation of any of the provisions of these Terms and Conditions
      2. If you do not respond to our communications for a certain period of time
      3. In any other cases in which the Company deems the use of the Service to be inappropriate.
    2. In no event shall we be liable to you for any damages incurred by you as a result of any action taken by us pursuant to this Article.
  5. Article 5 (Disclaimer of Warranty and Disclaimer of Liability)
    1. We do not warrant, expressly or impliedly, that the Service will be free from defects in fact or law (including defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors or bugs, infringement of rights, etc.). (2) Even in the case of the proviso of the preceding paragraph, we shall not be liable for damages arising out of special circumstances (including cases in which we or the user foresaw or could have foreseen the occurrence of the damages) among damages incurred by the user as a result of default by us (excluding gross negligence) or tort. (2) In no event shall the Company be liable for damages arising out of special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of such damages), even if the Company’s negligence (excluding gross negligence) or tortious behavior causes the User to suffer such damages.   7. Article 7 (Modification of Terms of Use)

    2. User’s use of the Service after any modification of these Terms of Use shall be deemed to constitute User’s agreement to such modification of these Terms of Use.
  8. Article 8 (Handling of Personal Information)

    The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company’s “Privacy Policy”.

  9. Article 9 (Prohibition of Assignment of Rights and Obligations)

    The User may not transfer or offer as security his/her position under the User Agreement or rights or obligations under these Terms of Use to any third party without the prior written consent of the Company.

  10. Article 10 Other Disclaimer
    1. The Company shall not be liable for any and all damages incurred as a result of the user’s inability to use the Service.
    2. In the event that a user causes damage to a third party through the use of the Service, the user shall resolve the matter at the user’s own responsibility and expense, and shall not cause any trouble to the Company, except when the damage is caused by reasons attributable to the Company.
    3. The user shall bear the costs related to the installation of equipment and communication devices necessary for the user to use the Service, as well as telephone charges, LAN and other usage fees and application fees required for the use of the Service.
    4. Users shall use the following recommended browsers to use the Service, and the Company shall not be liable for any problems arising from the use of browsers other than those recommended by the Company, nor shall the Company accept any questions.

  11. Article 11 (Governing Law and Jurisdiction)
    1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
    2. In the event of any dispute concerning this service (including court mediation procedures), the Saitama District Court, which has jurisdiction over the location of our head office, shall have exclusive jurisdiction. The Saitama District Court, which has jurisdiction over the location of the Company’s head office, shall have exclusive jurisdiction over any disputes arising in connection with the Service (including court mediation procedures).
